Welcome to Mellowdia. By accessing our website or using the Mellowdia app (the "Service"), you agree to these Terms of Use. If you do not agree, do not use the Service.

1. About Mellowdia

Mellowdia is an app that helps anyone improve their singing, from complete beginners to experienced singers. It offers personalized lessons and analytics about your practice. It is not a replacement for a vocal coach. It is made for students and for vocal coaches: students get personalized lessons and progress tracking, and coaches get analytics to support their students. Mellowdia is for educational and entertainment purposes only, and nothing in the Service is medical advice. It is not a substitute for a qualified voice teacher, speech-language pathologist, laryngologist, ENT doctor or any other medical professional.

2. Assumption of risk and disclaimer of liability

Singing and vocal exercise carry physical risks. Improper technique, overuse, singing too loudly, too high, too low or for too long, or singing while ill or in pain can lead to vocal strain, vocal nodules, polyps, hemorrhage, hoarseness, loss of voice, throat injury, jaw strain or pain (including temporomandibular joint problems), hearing damage or loss, tinnitus, and other injury to the vocal folds, throat, jaw, ears or any other part of the body.

You use Mellowdia entirely at your own risk. To the maximum extent permitted by law, Mellowdia and its owners, developers, employees and partners are not responsible or liable for any injury, damage or health condition, including but not limited to vocal nodules, damage to your vocal cords, throat, jaw, ears or any other organ or part of your body, that results from or is connected to your use of the Service.

If you feel pain, discomfort, strain or hoarseness, stop immediately and consult a doctor. Keep volume at a safe level, especially when using headphones. If you have a medical condition affecting your voice, throat or hearing, talk to a doctor before using the Service.

Do not do vocal exercises while driving. Do not use Mellowdia, or do any vocal exercises that require you to look at, listen to or interact with the app, while driving, cycling or operating any vehicle or machinery. Doing so can distract you and cause accidents. We do not recommend it, and if you do it, you do so entirely at your own risk. Mellowdia is not responsible for any accident, injury or damage that results.

3. Your agreement

By using the Service you confirm that you have read this section, that you understand the risks described, and that you accept them. Use of the Service means you agree to these Terms.

4. Eligibility

You must be at least 13 years old, or the minimum age required in your country, to use the Service. If you are under 18, you need the permission of a parent or guardian.

5. Your account and conduct

You are responsible for the information you provide and for activity under your account. You agree not to misuse the Service, interfere with its operation, attempt to access it without authorization, or copy, resell or reverse engineer it except as permitted by law.

6. Intellectual property

The Service, including its name, logo, design, content and software, belongs to Mellowdia and its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable license to use the Service for its intended purpose.

7. Service availability and changes

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not guarantee that it will be uninterrupted or error-free, or that it will improve your singing. We may change, suspend or discontinue any part of the Service at any time.

8. Limitation of liability

To the maximum extent permitted by law, Mellowdia will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of or inability to use the Service. Where liability cannot be excluded, it is limited to the amount you paid us, if any, in the 12 months before the claim.

9. Termination

We may suspend or end your access at any time if you break these Terms. You may stop using the Service at any time.

10. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date shows the latest version. Continuing to use the Service after changes means you accept them.
